The MCP has the Toad appearing in Thunderbolts #53. I'm not seeing him -- I see some other former X-villains on a monitor shot, but that's it.
Same with Fallen Angels #1 -- MCP lists him as being behind the scenes, but I only see him in a "memory" shot, of Magneto thinking back to the original Brotherhood of Evil Mutants.
Am I missing something, or are these MCP boo-boos?

No -- neither original-form Toad nor Ray-Park-looking Toad appears in either issue, that I can see.

On page 12, panel 2, Clint Barton is walking through Seagate Superhuman Prison. Among the inmates who are staring at him is a prisoner who is crouching. That crouching prisoner looks like the Toad.

Ah! Yes, I think you're right. And the Toad *should* be in prison at this time, too, having been defeated and presumably captured in the "Eve of Destruction" crossover.
