Danny Shepard, the Heartbreak Kid, has only two appearances, but they are listed in the wrong order.
In ASFY2 15/7 he meets Peter Parker a few days after Uncle Ben's death, while in NDEF 140 he meets the Defenders, so it takes place much later.

Danny harasses his teacher, Edna May Terry, using his powers on her. These are the events that lead to his being on trial, a situation in which we find him in NDEF 140. So the flashback takes place just before the main story.

It's weird though, because in AFSY2 15/7, Danny has been on the road for two years since leaving school in Abbotsford, and this is just after Ben Parker was killed. In NDEF 140 & -FB, he's still a student at Abbotsford High School. I guess he returned after a few years, and went back to school.

Yes, unless time travel is introduced (but there is no evidence for this) it is the only possible explanation. Simply the fact that Peter Parker still goes to school cannot be reconciled with the Defenders team that includes Moondragon, Beast, Angel, Iceman etc..
